Licensing of Import and Export Commodity Inspection and Surveying Body
2. Licensing Conditions
(1) If the Chinese-invested import and export commodity inspection and surveying body wants to apply for the licensing, it should meet the following conditions:
i. Investors or one party of the investors should be the independent institutions (institution) which, in third party capacity, have/has been involved exclusively in the inspection and surveying business for at least 3 years.
ii. The registered capital thereof shall be at least in the amount of RMB that is equivalent to USD 350,000.
iii. It shall have the test conditions and technical resources adequate for the inspection and surveying business in which it engages; it shall have fixed residence, working place, testing site and the scale necessary for the business it develops;
iv. It shall have the quality management system that meets the relevant general requirements;
v. The professional technicians involved in inspection and surveying shall acquire the qualification certificate as required by the AQSIQ, and the number of persons who have acquired the qualification certificate shall be no less than 2/3 of the total number of staffs in the institution.
(2) If the foreign-invested import and export commodity inspection and surveying body wants to apply for the licensing, it should meet the following conditions:
i. The foreign investors of the foreign-invested import and export commodity inspection and surveying body shall be the legitimate body that has been registered independently in its own country and engaged in the inspection and surveying business for over 3 years in that country;
ii. The Chinese investor or one party of the investors in the import and export commodity inspection and surveying body in the form of Sino-foreign equity or contractual joint venture shall be an independent institution which, in third party capacity, has been involved exclusively in the domestic inspection and surveying business for at least 3 years;
iii. The registered capital thereof shall be no less than USD 350,000;
iv. It shall have the test conditions and technical resources adequate for the inspection and surveying business in which it engages; it shall have fixed residence, working place, testing site and have the capability for transnational operation;
v. It shall have the quality management system that meets the relevant general requirements;
vi. The professional technicians involved in inspection and surveying shall acquire the qualification certificate as required by the AQSIQ, and the number of persons who have acquired the qualification certificate shall be no less than 2/3 of the total number of staffs in the institution.
3. Implementation Bodies
Acceptance body: Shanghai Entry-Exit Inspection and Quarantine Bureau (Acceptance division: Division for Supervision on Certification)
Approval authority: AQSIQ
If the applicant’s Chinese investor is the large enterprise governed by certain department of the State Council, both the acceptance body and the approval authority will be AQSIQ.
4: Procedures
(1) For the applicant of which the Chinese investor is the large enterprise governed by certain department of the State Council:
i. The applicant shall apply to the AQSIQ and submit relevant materials (see annex for the catalogue of materials).
ii. The AQSIQ shall, based on the completeness and compliance with legal form of the submitted materials, decide whether to accept the application or not, and issue a written document as prescribed.
iii. After accepting the application, the AQSIQ shall examine the application materials thoroughly according to the regulation, and conduct on-site audit on the working place, testing site, as well as the test conditions and technical capacity as required for
